Sander moved to open the public hearing for the consideration to amend to the Flood Hazard Overlay District in the Richmond Zoning Regulations. Hill seconded.

Clarke reviewed what has happened with the project starting in June 2024, regarding relocating the playground, altering the bandshell structure or relocating the restroom. Relocating is the appropriate term because building new structures in the floodplain is restricted by zoning. Furr mentioned that the current bandshell does not allow for ADA access and would adding a ramp change the footprint. Oborne replied that adding accessibility is allowed and does not alter the footprint. Clarke mentioned that a protective fence around the playground once it is relocated will be important. Thomas explained that as a representative of the Parks and Rec committee she thinks they will be able to work within the new zoning regulations. Bressor mentioned that a footprint of a structure is defined as where it is in contact with the ground. Clarke described that a catwalk even if above ground is part of the square footage.

Hill moved to close the public hearing. Filkins seconded.

Per 24 V.S.A. §4442, Wood hereby moved that the Town of Richmond Selectboard approve amendments the Flood Hazard Overlay District in the Richmond Zoning Regulations. These amendments shall be effective 21 days after adoption. Sander seconded.

Sunshine wants to name the road after himself and needs the Selectboard’s approval.

Sander moved to approve the name “Sunshine Lane” for the new road which will be created with the two-lot subdivision at 1582 Jericho Rd.

Hill seconded.

The hammerhead that was approved at the last meeting needs to be moved 60 feet to the East and must be reapproved by the Selectboard.

Wood moved to approve a change in location for the hammerhead turnaround on the two-lot subdivision at 1582 Jericho Rd. as presented in the updated plans. Sander seconded.

Evaluation of a public officer: possible executive session

Sander moved to find that premature public knowledge about the evaluation of a public officer would cause the Town or person to suffer a substantial disadvantage. Hill seconded.

Filkins moved that we enter executive session to discuss the evaluation of a public officer under the provisions of 1 VSA 313(a)(3) and to invite Development Review Board Chair David Sunshine and Town Manager Josh Arneson into the executive session. Sander seconded.

Arneson stated that a ladder was donated to the Town in 2023, and now Umiak wants to reinstitute an agreement regarding usage of the ladder, parking a trailer at Overocker park during the day, changing signage and usage of the trails for their customers for 2025. Hill asked where the trailer would be parked, which Brownlee replied would be in the far back corner and only during daytime hours. He continued that the ladder would be inspected for safe usage.

Sander moved to approve the Agreement for Facilities Use between the Town of Richmond and Umiak as presented. Filkins seconded.

Update on advocacy organized by the Vermont League of Cities and Towns for the legislative process regarding 3-acre storm water permit and consideration of a Selectboard member providing testimony to the Senate Natural Resources Committee

Arneson said they were looking for names of people to testify sometime this week. Filkins recused herself because this directly impacted her. Thompson stated that he, Sarah Heim, and Paige Kaleita will be testifying this week. Furr asked if it was in person or online as he may be able to present, which it was stated that the meeting is on Zoom. Wood wondered what the format of a presentation entails, which Hill mentioned he has seen some people have PPT or simply show up in person and present. Hill read off the VLTC website. Kittinger said he is having problems getting timely updates regarding the stormwater issue from the Town’s assessor. Arneson stated he will talk to the assessor, Lisa, this week. Hill wants to know what the impact of this is for a homeowner who wants to sell their house in a Stormwater affected area, which no one seemed to know. Furthermore, he wonders how flooding affects property values. Wood concurred and said it's tricky with the current housing market.

Review of the Highway Department Summer Work Plan

Gosselin gave an overview of what work his department has been doing on roads and what he plans on doing moving forward. During summer, the vacation schedule for his crew splits so half the people are on duty. Sidewalk repairs are pushed until July. Grading is part of constant road maintenance. Guardrails in Southview will be replaced up to the Jericho Rd bridge. Drain systems on Tilden Ave will be cleaned out. Contracted items this year is paving. The hours for his crew will be 06:00a to 4:00p Mon through Thurs. Furr wanted to know about painting the street and the no parking zone on Route 2, which Gosselin said will happen this summer.

Gosselin explained that the paving grant is for 2 miles of Jericho Rd, which is a class 2 road. The total project cost is estimated at $373,800. If approved, the State grant would pay up to $200,000 for this project, the remaining amount would come out of the FY26 Retreatment budget. Hill asked where these funds come from because the State’s funding has been uncertain recently.

Gosselin continued the structures grant is for a culvert on Stage Rd. which has washed out multiple times in high rain events, including the July 2023 and July 2024 floods. The total project cost for upsizing this culvert is estimated at $486,277. If approved the Grant would pay for max $200,000 of the project with the remaining being paid for with funds from the Bridge and Culvert Reserve. This is the seventh time he has applied for this grant. If he gets this grant, it could become an in-house project and would save money.

Arneson added that the Selectboard needs to sign off on a TA60 form which certifies that the Town raises at least $300 per mile of roads in the Town, and the Certification of Compliance for Town Road and Bridge Standards. The Town spends far more than this on its roads.

Wood moved to approve form TA60, the Certificate of Compliance for Town Road and Bridge Standards, and to apply for the Structures and Highway Paving grants and to name Pete Gosselin as the Grant Program Manager. Sander seconded.

Hill asked which truck this was replacing, and he said it is for a 2019 truck that is out of warranty, because it’s on a 5-year warranty plan. Most trucks in the Highway Dept are on 7-year warranty plans now.

Sander moved to approve Purchase Order number 5164 to Allegiance Trucks for a purchase of a tandem axle and chassis for a new plow truck in the amount of $188,346.00.Filkins seconded.

Consideration of selling the Highway Department’s zero turn mower

Gosselin recommends putting the commercial grade zero-turn mower up for sale in a sealed bid process with a minimum bid of $2,000. This was purchased in June 2017 for $7,400.

Bressor explained his property has been flooded several times and it takes about $17,000 each time to put it back together. They now want to move their driveway 90 feet as well as their parking area to avoid it being underwater. He has already talked to Zoning administrator Tyler Machia regarding this. Hill wondered about the distance from the bridge to the location Bressor is proposing. Gosselin said this area was flagged as safer already last year and it is in compliance with the Town’s road specs.

Rosovsky said last year’s flood deposited sand and silt, and they now want to mulch and repair or replace some of the trees to improve growth. Hill asked about the erosion of the riverbank. Rosovsky stated that planting trees was an impetus to reduce some flooding and be proactive to avoid further erosion, especially because the river is straight and fast there, and the banks are caving in.

Wood moved to approve the use of $700.00 from the Conservation Reserve Fund to cover the cost of supplemental trees for Volunteers Green as described in the proposal dated March 3, 2025. These funds must be expended within 3 years of the date of final approval, April 7, 2028. Sander seconded.

Daniels explained that this course has been offered in Richmond before and this is a request for $3,500.00 to support the Vermont Master Naturalist training program which will be offered to residents of Richmond, Williston, and Huntington. Filkins asked about the age ranges of participants, and Daniel said every age from 16 to over 70, they are proud to serve all ages. Furr mentioned that MMCTV might be interested in filming one of these field trips.

Sander moved to approve the use of $3,500.00 from the Conservation Reserve Fund to support the Vermont Master Naturalist training program, and the use of $675.00 from the Conservation Reserve Fund to support one scholarship for the training program. Filkins seconded.

Update on UVM Richmond Climate Study

John said they are changing the date to May 11, 2025 and removing volunteers on the course for safety reasons.

Arneson explained that the vast majority of this race is on trails not on roads, and there have been no complaints in the past. Around 80 runners completed this event in prior years.

Update on progress of the Police Governance Committee

Furr said the Hinesburg Selectboard has accepted this arrangement with some changes. The supervision of the Hinesburg police has now changed to the Town Manager of Hinesburg. Hill thinks the supervision of current and future police in Richmond should not be managed by the Town Manager of Hinesburg. Arneson thinks it’s implied that the Richmond Town Manager oversees any Richmond police officers.

Sander moved to approve the agreement with Hinesburg for shared police chief services. Hill seconded.

Follow up on the Special Selectboard Meeting held to discuss the Fire Department

Arneson thought it was a productive meeting and suggestions for recruitment were shared. Assistant Chief Jerry Levesque has already started talking with Hinesburg Fire Chief Prescott Nadeau about how to combine training between the two departments.

This is for Step 1 design for flood mitigation of the Wastewater Pump and Force Main that runs under the Bridge St. bridge. The full loan amount is $78,508, but the loan comes with a 50% subsidy, so $39,254 will need to be paid back by the Water and Sewer Commission.

Wood moved to accept the loan from the Clean Water State Revolving Fund for Step 1 design of a flood mitigation project for Wastewater Pump and Force Main, noting that the loan will be paid by receipts from the Water and Wastewater Department. Sander seconded.

Consideration of changing the name and scope of work of the Town Center and Library Buildings Committee
