Consideration of adopting a resolution to Condemn Surveillance and Enforcement Practices of Federal Immigration Agencies

Houle thought the Selectboard was getting over its skis by considering a resolution to condemn surveillance and enforcement practices of a federal agency. It does not say non-binding. Wood summarized the debate about whether the actions they have seen publicly are illegal or not. Wood stated that they are voicing an opinion of some members of the Town to condemn this because they disagree with the practices.
Filkins stated that if they do not say something right now, then that is going against democracy. They do not have the right to enforce federal laws, however this says that they will not be supportive of any of those actions.
LaBounty stated that the Selectboard is not representing everybody. LaBounty asked what is the Selectboard going to do if it happens. Filkins stated that she has been advocating for this resolution as a means to put on paper in this Town what we will do and stand by it. Filkins stated that there's folks that are already scared, not feeling safe, looking to the Town to decide how they can work and be a part of this community. Houle stated that post-911, Congress passed the Patriot Act, which allows exactly what they're talking about. Sander stated that he has family members who are living in fear and here legally. Wood summarized how it reaches across State boundaries and generations of legal status.
Rabideau stated that he wanted the resolution to be refined and appropriate. Rabideau summarized his experiences that as a border State they do provide necessary function, and the people were professional and patriotic. Rabideau stated that if a law enforcement has interest in people, they go to a judge/grand jury to probable cause. Rabideau stated that he wrote a letter to Becca Balint and our two senators to ask them to do something about it. Rabideau referred to the useful information provided by the Police Chief last meeting. Rabideau summarized his general discomfort with this being Town business. Rabideau suggested that some of this may need a little tune up before they made this public policy. Hill stated that it is reasonable to let it season a bit and suggested meeting with Filkins. Filkins stated that they are here to uphold the values and the rights of people and continue to do things with Chief Cohen here and support people that need more information or who want to have a different opinion conversation.
van Eeghen reviewed how the Selectboard has drawn more closely to civic issues in the past 5-6 years. van Eeghen stated that it is Town business on the assumption that the rule of law works in this country and if they begin to suspect that it does not work, they have an obligation to speak up.

Filkins stated that she appreciated Rabideau’s comments and if this moves forward there are still amendments they can make.

Hunter presented the FY25 Financial Audit report from the information in the packet. Hunter stated that the Town has the highest unqualified audit opinion out there so kudos to your team for getting that designation. Hunter added that there were no management letter recommendations for the Town this year as far as best practice improvements. Sander stated that a clean audit wasn't a coincidence, it was thoughtful planning with Town staff, auditors, finance director, and this board.

Arneson presented the financial actuals for the first six months of the fiscal year. In general, they are looking at ~50% of expenses. Revenue is going to show ~100-110% due to some people paying their taxes ahead of time. Delinquencies haven't been a very big problem for the Town for the last number of years. Police continue to be very much under budget due to some vacancy savings. Fire Department is also at about 27% of the budget. The Highway Department is at about 52% of their wages through the end of December, and that's going to continue to increase with overtime in January and February. Sand is showing it's over budget and there is a pretty good salt shortage right now. Highway is mixing in some sand to some of the paved roads to cut back on the amount of salt used.

Arneson reviewed how the Finance Director, Bona, has done a great job reinventing Capital Plan over the last 4-5 years. It never used to be in such a nice, presentable manner
Sander moved to set a hearing date of Monday, March 16, 2026 for the FY27 Capital Plan. Hill seconded.

Public Hearing to review the changes made by the Selectboard at their January 21, 2026 meeting to the 2026 Town Plan that will be voted on by the voters on Town Meeting Day, March 3, 2026

Wood reviewed that the January 21 hearing change the map that was proposed by the Steering committee and reverting back to the CCRPC map. They cannot make any changes tonight as it is warned on the Town Meeting ballot.
Hill moved to open the public hearing to consider the 2026 Town Plan Update. Filkins seconded.

Clarke reviewed that rationale for doing this was at the previous Selectboard meeting and the Planning Commission reported that they are good to go. LaBounty requested that the new map is going to be printed as part of the Town Plan document. Oborne confirmed that would be completed by the end of the week.
Sander moved to close the public hearing for the 2026 Town Plan Update. Rabideau seconded.

Sander moved to approve the fourth draft of the 2026 Town Plan to include the CCRPC FLU Map as the Richmond FLU Map 2.0. Further, the Selectboard directs the Richmond Planning Commission to forward what is now considered the Final 2026 Town Plan draft to Regional Planning for consideration and adoption. Rabideau seconded.

Public Hearing to consider amendments to the Traffic Ordinance to increase the parking penalty on certain roads, add a waiver penalty, add penalty schedule, add authority for Richmond Community Officer to issue parking tickets, and clarify parking ticket appeal process

Sander moved to forgo reading the entire ordinance aloud and read only the title. Hill seconded.

Arneson presented the changes in Section 9 highlighted in red from the packet. The meat of it is to increase parking ticket penalties from $50 to $150 on certain roads shown on a map detailed on Cochran, Dugway, Duxbury and West White Hill Roads. There are waiver penalties so if people pay their ticket within 30 days, then they would pay $100 for a $150 ticket and $30 for a $50 ticket. It also adds authority for the Richmond Community Service Officer to issue parking tickets. Arneson highlighted the spots where there would be signs that state the increased parking fees. Arneson reviewed that they don't want to write a bunch of parking tickets, they just want people to park in a safe manner.
Hill moved to close the public hearing to consider amendments to the Traffic Ordinance. Rabideau seconded.

Wood reviewed the posting process and that this would not go into effect until April 18, 2026.

Consideration of approving a grant application to fund a roof replacement at the Richmond Free Library

Dana presented the request to approve an application for a grant through the Vermont Department of Libraries. The Library is proposing the replacement of slate on the Library roof which is about 150 years old. The Library got an estimate for two options, $265,000 for replacing the roof or $100,000 for repairing the roof but recognizing that would be every 5 years or so. The application deadline is March 31, and they will be notified this summer. This is a reimbursement grant so the Town would have to outlay their funds and then submit the invoices. Arneson reviewed that there is no acceptance until they get the actual grant.
Hill moved to approve the grant application to the U.S. Department of Housing and Urban Development Public Facilities Preservation Initiative Grants for Small, Rural Public Libraries for funding to replace the roof of the Richmond Free Library. Sander seconded.

Consideration of approving a request from Project All Together Now for $3,000 from the Community Well Being budget line

Lavoie presented how they host events to build connections within the community that would help youth with mental health and break the stigma around mental illness. The money will go toward resources and stipends for youth interns. The program is throughout the Mount Mansfield School District with several interns from the Town of Richmond.
Filkins moved to approve the request by Project All Together Now for $3,000 from the Community Wellbeing budget line. Sander seconded.

Consideration of approving a request to use funds from the Conservation Reserve Fund for a public wildlife education event focused on the negative impacts of rodenticide

Galvin reviewed the $400 request for a couple of local Conservation Commissions to host cross-town events to bring people together around conservation and wildlife related issues. The request from Richmond is greater than other towns based on the population. Somewhere between March and April would be the desired time of the event. Hill suggested holding the event before the Fall when the rodents tend to come into houses and to record it to make it available to those who cannot attend.
Rabideau moved to approve the use of $400.00 from the Conservation Reserve Fund for a public wildlife education event focused on the negative impacts of rodenticide. Sander seconded.

Ward summarized that this is the 6th year she has presented this request and it is the same as in the past. Community, joy, and adventure are the big themes. They have had over 200 bikes donated and give them to kids with a fit checked helmet. Richmond Rescue provides CPR skills training. The Kelly Brush Foundation shares adaptive bikes to instruct children. They request a road closure because the river trail is not as reliable as it used to be.
Filkins moved to approve the closure of Cochran’s Rd., from Cochran’s Ski Area to Dugway Rd., from 11:00 am to 1:00 pm, on Saturday May 16, 2026 for the Children’s Bike Ride portion of the Richard’s Ride event. Sander seconded.

Review of a request for an easement for 1) an existing wastewater line that serves 10 East Main St. but runs under the municipal parking lot at 27 Bridge St. and 2) an existing concrete pad for dumpsters at 10 East Main St. that is partially on the 27 Bridge St. property, possible executive session

Kinnaman, the property owner and CEO of the business inside the building, summarized the letter in the packet. There are some Title objections against the property, one related to the lack of easement on the sewer line that runs under a portion of the Town municipal parking lot, and the other one is the dumpsters sitting on a concrete pad. There is a draft easement written and they want to understand any conditions from the Selectboard. They are asking for a 10-foot corridor on top of the sewer line which would encompass the dumpster pads.
Rabideau stated that he hopes in doing this that they do not reduce the amount of available parking. Arneson suggested adding consideration for the attorney fees incurred by the Town. Kinnaman confirmed those requests were reasonable and he just wants to make sure they have a path forward. Kinnaman reviewed that he will provide the Town attorney with the formal easement and he will be back at the next meeting. Arneson confirmed that he will talk to the attorney about making sure there is parking allowed over it, the covering of attorney fees and if there is an excavation then it triggers a straightening of the line.
Update on an agreement for engineering for the Southview Stormwater 3-Acre Permit

Arneson stated that the engineer knows they want to submit the NOI by summer or sooner. They are going to have a meeting with the State next week.

Update on Chittenden Country Regional Planning Commission’s Municipal Elected Official Forum on 3/30/2026

Wood reviewed how he and Filkins attended it last time and it was a casual discussion between different boards and government officials at the Municipal level in Chittenden County. Hill suggested that the Chair and Vice-Chair attend. Wardwell stated that they have to register by March 23, so they have a meeting after Town Meeting Day to decide. Arneson confirmed he will put this on the Selectboard agenda for March 16, 2026.
Filing of rule with the Selectboard to prevent the abuse of highways from November 15th – May 15th of the following year

Arneson stated that this is a rule VTRANS puts out every year that is filed with the Selectboard and the Highway Foreman posts the roads as soon as appropriate. There's really no action, just an acknowledgement of notifying the Selectboard and he will post in the public places tomorrow
